General Terms and Conditions (GTC) of ARB Physiotherapy

1 Scope of application

These General Terms and Conditions (hereinafter referred to as "GTC") govern the legal relationship between ARB Physiotherapy and the patient (hereinafter referred to as "the patient").
The GTC apply in the version currently valid at the time the treatment is carried out and govern the business relationship of the booked treatment (hereinafter "the treatment"), unless otherwise agreed in writing.

2. data protection

We collect, process and store personal data in accordance with the applicable data protection regulations in Switzerland. The ARB Physiotherapy privacy policy can be viewed at www.arbphysio.ch/datenschutz. By using our services, the patient agrees to the privacy policy.

The patient files belong to ARB Physiotherapy. The patient has the right to inspect and obtain copies of their files at any time. The files are stored by ARB Physiotherapy, used for treatment and used for billing and debt collection.

The data required for invoicing and managing patient data and appointments is transmitted to the software provider.
Medical data and administrative patient data may be exchanged with or obtained from referring and treating physicians, insurance company medical officers and Swiss insurers to the extent necessary for treatment or billing.

3 Cancellation conditions

Booked appointments are binding and the reserved time is intended exclusively for the patient. Appointments that are not kept or canceled too late cannot be covered by health or accident insurance.

The patient undertakes to cancel appointments at least 24 hours in advance.
In the event of late cancellation or no-show, the following no-show fee will be charged privately:

  • Physiotherapy (prescribed by a doctor): CHF 80.
  • Private physiotherapy / medical coaching: according to the booked service

In the event of repeated missed appointments, ARB Physiotherapy reserves the right to make further appointments only against advance payment.

4. payment regulation

Medically prescribed services are invoiced directly to the health insurance company in the Tiers payant system. The health insurance company will invoice the patient for any co-payments (deductible/excess).

All costs that are not covered by the insurance - for whatever reason - are borne entirely by the patient.

The following reminder fees apply in the event of late payment:

  • Reminder: CHF 10.
  • Last reminder: CHF 20
  • After two unsuccessful reminders, the case will be handed over to a debt collection agency (additional costs: CHF 28).

Services charged privately (e.g. medical coaching, massage, private physio) must be paid before the next appointment or within 30 days of the invoice date at the latest.

Payment options on site: Cash, debit/credit cards, Postcard, Twint.

5. refunds (Tiers Payant)

Insurance companies or health insurers may reclaim invoices already paid from the patient. By accepting these GTC, the patient confirms:

  • He/she accepts all reimbursements requested by an insurance company in connection with invoices from ARB Physiotherapy.
  • ARB Physiotherapy is not obliged to process requests for reimbursement from insurance companies.
  • Requests for reimbursement will be forwarded directly to the patient.
  • The patient releases ARB Physiotherapy from any repayment obligation - even if ARB Physiotherapy would be legally obliged to reimburse the patient.
  • The patient is responsible for all communication, clarification, processing and settlement of such reimbursement claims.

6. refusal of payment by insurance companies

In the event of uncertainties regarding the assumption of costs (e.g. MTT, private treatments), the patient undertakes to obtain a cost approval from the health insurance company in advance.

The patient checks all invoices and informs ARB Physiotherapy if anything is unclear.

7 Treatment

Treatment is carried out in accordance with current physiotherapy and medical massage standards. As is usual with medical services, a specific treatment outcome cannot be guaranteed.

8 Place of jurisdiction and applicable law

The exclusive place of jurisdiction is Zug, Switzerland.
Swiss law applies exclusively, excluding the conflict of laws.

9. final provisions

ARB Physiotherapy may amend these GTC at any time. The current version is available at www.arbphysio.ch/agb and comes into force immediately upon publication. should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the statutory provision.
